STATUTE
VOIVODSHIP HOSPITAL
IN BIELSK – BIAŁA
General provisions
§ 1
1. The Provincial Hospital in Bielsko-Biała, hereinafter referred to as the “Hospital”, is a medical entity that is not an entrepreneur within the meaning of the Act of April 15, 2011.
on medical activity (uniform text: Journal of Laws of 2015, item 618, as amended), hereinafter referred to as the “Act”, conducted in the form of an independent public health care facility.
2. The entity creating the hospital is the Śląskie Voivodeship.
3. The seat of the hospital is the city of Bielsko-Biała.
§ 2
1. The hospital is entered in the register of entities performing medical activities, kept by the Silesian Voivode, under the number 000000013794.
2. The hospital has legal personality and is entered in the register of associations, other social and professional organizations, foundations and independent public health care facilities, kept by the District Court in Bielsko-Biała, 8th Commercial Division of the National Court Register, under number 0000063066.
Goals and tasks
§ 3
The purpose of the hospital is to:
1) providing health services to preserve, save, restore or improve health as well as other medical activities resulting from the treatment process or separate provisions regulating the principles of their performance;
2) health promotion.
§ 4
The tasks of the hospital include:
1) providing inpatient and 24-hour hospital health services;
2) providing outpatient health services;
3) conducting diagnostic activities;
4) providing pharmaceutical services;
5) running a blood bank;
6) carrying out activities in the field of public health, including disease prevention, health promotion and health education;
7) participation in the implementation of teaching and research tasks in connection with the provision of health services and health promotion, including the implementation of new medical technologies and treatment methods;
8) participation in the preparation of persons for the practice of medical professions and training of persons practicing medical professions on the terms set out in separate provisions governing the education of these persons;
9) ruling on health and temporary inability to work;
10) implementation of specific tasks commissioned by the competent authority related to civil defense, defense matters and protection of the population.
§ 5
The hospital may conduct separate organizational activities, including economic activities, other than medical activities, consisting in:
1) renting, leasing, putting into use the fixed assets of the Hospital;
2) providing hotel services;
3) providing parking services;
4) providing transport services;
5) provision of catering services;
6) providing medical waste disposal services;
7) provision of laundry services;
8) provision of forensic services;
9) provision of disinfection and sterilization services for medical equipment;
10) providing photocopying services;
11) conducting training activities for the benefit of persons authorized to provide health services;
12) making the resources of the Hospital available to other entities in order to conduct training activities for the benefit of persons authorized to provide health services;
13) making available the resources of the Hospital and providing services in relation to it
with the conduct of clinical trials;
14) storing the body.
Organs and organizational structure
§ 6
The hospital authorities are:
1) Director;
2) the Social Council.
§ 7
1. The Director manages the Hospital, represents it outside, makes decisions concerning its functioning and is responsible for them.
2. The director is the superior of all employees of the Hospital and acts as an employer for them within the meaning of the provisions of the Labor Code.
§ 8
1. The Social Council operates at the Hospital, which is the body of:
1) initiating and advising the Śląskie Voivodeship;
2) advisory services to the Director of the Hospital.
2. The Social Council is appointed and recalled by the Board of the Śląskie Voivodeship.
3. The Social Council consists of 7 to 11 people, including:
1) as the chairman of the Marshal of the Śląskie Voivodeship or a person designated by him;
2) as members:
a) a representative of the Silesian Voivode,
b) from 5 to 9 members elected by the Sejmik of the Śląskie Voivodeship.
4. The term of office of the Social Council is 4 years.
5. Dismissal of a member of the Social Council before the end of the term of office may take place in the following cases:
1) resignation;
2) unexcused absence at three consecutive meetings of the Social Council;
3) disease that permanently prevents the performance of the tasks entrusted to him;
4) conviction by a valid court judgment for an offense prosecuted by public indictment or a tax offense;
5) taking up employment in the hospital;
6) at the request of the authority authorized to appoint its representative.
6. In the event of dismissal or death of a member of the Social Council before the end of the term of office, supplementation of the composition of the Social Council takes place at the initiative of the body of which that member was a representative.
7. After the end of the term of office, the Social Council shall function until the composition of the next term of office is appointed.
8. The first meeting of the Social Council is convened by the Marshal of the Śląskie Voivodeship.
§ 9
1. The tasks of the Social Council are determined by the provisions of the Act.
2. The tasks of the Social Council also include issuing opinions on matters relating to the Hospital, if such a requirement arises from a resolution of an authority of the Śląskie Voivodeship.
3. The Social Council may express an opinion on matters essential for the functioning of the Hospital, other than those mentioned in sec. 1 and 2.
§ 10
1. The hospital consists of enterprises in which medical activities are performed:
1) Hospital;
2) Outpatient Healthcare.
2. The companies referred to in para. 1, include units and organizational units of a medical nature.
3. Organizational units of non-medical and auxiliary activities as well as independent workstations operate in the Hospital.
4. The internal organization of the Hospital, including the structure of enterprises, organizational units of non-medical and auxiliary activities, and independent workplaces, is specified in the Hospital’s Organizational Regulations.
Financial economy
§ 11
1. The hospital conducts financial management based on the principles set out in the Act.
2. The hospital keeps accounting based on the generally applicable regulations in this regard.
3. Disposal of the hospital’s fixed assets, lease, rental, use (including obtaining funds) and lending may only take place on the terms set out in a separate resolution of the Board of the Śląskie Voivodeship.
Final provisions
§ 12
The statute is granted and amended by an appropriate resolution by the Sejmik of the Śląskie Voivodeship.
